These Terms and Conditions of Use (the «TCU») form a contract that binds Users (individuals or entities accessing the site for free, as well as Members and Premium Members), Members (individuals or entities accessing the site by registering for free), Premium Members (individuals or entities accessing the site and additional features as paying subscribers), and define the terms of availability and use of the Website (url https://appaloo-equestrian.fr) and the services offered by this site.
These provisions are complemented by our Privacy Policy .

2 - Use of the Website

Access Conditions

Access to the Website is possible at any time, except in cases of force majeure, malfunction, or necessary maintenance interventions for the proper functioning of the site.

Using the Website implies full acceptance of these TCU, as well as our Privacy Policy and our T&Cs. The TCU may be modified at any time by Appaloo Equestrian. Therefore, it is recommended that Users, Members, and Premium Members consult them regularly.

When registering on the Website, the Member or Premium Member must complete a form, in which they agree to provide accurate and complete information that does not infringe on the rights of third parties and is not contrary to public order or good morals. In the event they provide false or inaccurate information or fail to comply with the rules of good practice, Appaloo Equestrian reserves the right to suspend or delete access to the Website and its services. A minor can only register on the Website with the consent of their legal guardians. The guardians acknowledge that it is their responsibility to monitor the use made by minor children of the services.

Any internet user who refuses to check the "I accept the Terms and Conditions" box during registration will be denied membership on the Appaloo Equestrian Website.

Exercise Sharing

To share an Exercise, you must first be a Member of the Website. By completing the form, you guarantee that:
To your knowledge, this exercise does not come from a published work.
You authorize Appaloo Equestrian to distribute this Exercise on its site and integrate it into its database for free.
You authorize Appaloo Equestrian to distribute, publish, and reproduce it on the Site and any other communication medium (social media, printed materials, etc.)

The photos illustrating the exercises must not infringe on the rights of third parties. The Member must ensure they hold the rights to them.

The Member may, following the closure of their account, exercise their right to have their personal data erased by the publisher. The publisher will delete any identifying information from the published content, while reserving the right not to delete said content, which will then be anonymized.

Use of Exercises

The Appaloo Equestrian Website is for personal use only. Any extraction, use, reproduction, or distribution for other purposes, including collective and/or commercial purposes, without prior express written permission from Appaloo Equestrian is prohibited and may be subject to sanctions, including for infringement.

Comments

Members and Premium Members can comment on Exercises to share their opinions. Only their username and their comment will be visible on the comment. As with any written content, insulting, defamatory, or offensive remarks toward others are prohibited.

Code of Conduct

The Appaloo Equestrian Website is intended for the sharing of equestrian exercises. The User must respect the spirit of the platform and not misuse it.

The Member must not transmit viruses or any other code that could damage the Website, software, or hardware.

The Member must express themselves in a manner that is readable and understandable by all. They must respect other Members, and any abuse, insults, disrespect, or incitement to hatred or discrimination are prohibited and will result in the suspension or deletion of the account.

3 - Responsabilities

Appaloo Equestrian does not guarantee the results of the exercises published on its Website nor their quality. Appaloo Equestrian cannot guarantee that the exercises will meet the Users' expectations or that their content is accurate and reliable. Consequently, the responsibility of Appaloo Equestrian cannot be engaged in case of error or false information in an Exercise. Appaloo Equestrian is a participative platform, and therefore subcontracts information provided by its Members. The User works on his horse autonomously, Appaloo Equestrian must only serve as inspiration. Appaloo Equestrian invites you to use equipment adapted to the practice of horseriding and to wear protective equipment (gloves when lunging, helmet on foot and on horseback...etc).

Appaloo Equestrian disclaims any liability in the event that the Member injures themselves/falls and/or injures their horse while performing an exercise found on appaloo-equestrian.fr. It is the responsibility of each individual to assess the difficulty of the exercise and its suitability for the rider/horse pair's level.

Appaloo Equestrian disclaims any responsibility in the event that hyperlinks present in content published by Members violate applicable regulations. Any content downloaded is done so at the User's own risk. Appaloo Equestrian cannot be held liable for any damage to the User's computer/smartphone/tablet or any loss of data.

Any User of the Appaloo Equestrian Website agrees to indemnify and hold harmless the company Appaloo Equestrian against any damage, complaint, or demand from a third party resulting from the publication/ dissemination or sending of content via the Website.

4 - Intellectual Property

Any total or partial reproduction of the elements accessible on the site (logo, image, illustration, photographs, texts) is prohibited, unless prior written authorization is obtained from the publisher.

Any unauthorized use of the Appaloo Equestrian Website or any of its elements will be considered as infringement and prosecuted in accordance with the provisions of articles L.335-2 and following of the French Intellectual Property Code.

Appaloo Equestrian reminds users of the Website that it is strictly prohibited to reproduce content protected by third-party rights, particularly from books. Therefore, it is forbidden to reproduce in full exercises created by third parties, but it is allowed to draw inspiration from them to create your own exercises.
